1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Manuel Thurner / 03-Studios ("Company," "we," "our," or "us"), located at Weinstraße 6, 39057 Girlan BZ, Italy (VAT: IT03288300217), governing your access to and use of the ONYRA mobile application (the "App") and related services (collectively, the "Service").

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. If you do not agree to these Terms, do not download, install, or use the App.

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Eligibility

To use the Service, you must:

• Be at least 16 years of age (or the age of digital consent in your jurisdiction, if higher)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Account Registration and Security

While the App can be used without an account for basic dream journaling, certain features (including AI analysis and cloud synchronization) require account registration through Sign In with Apple or Google Sign-In.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized access or security breach
• Ensuring your account information is accurate and up-to-date

We reserve the right to suspend or terminate accounts that violate these Terms or pose security risks.

4. Description of Service

ONYRA is a lucid dreaming and dream journaling application that provides:

• Dream Journal: Tools to record, organize, and review dream entries via text and voice recording
• AI-Powered Analysis: Artificial intelligence features that analyze dreams, identify patterns, interpret symbols, and provide personalized insights (premium feature)
• Lucid Dreaming Techniques: Guided techniques including Reality Checks, Audio Cues, and Wake Back to Bed (WBTB)
• Progress Tracking: Statistics and visualizations of your dream recall and lucid dreaming progress
• Cloud Synchronization: Cross-device sync for premium subscribers

5. AI-Powered Features and Disclaimers

5.1 AI Limitations

• AI-generated dream interpretations are not professional psychological, medical, or therapeutic advice
• AI analysis may contain inaccuracies, errors, or inappropriate content
• AI cannot replace qualified mental health professionals
• Results are algorithmically generated and may not reflect accurate interpretations of your dreams

5.2 No Medical or Therapeutic Advice

THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, PSYCHOLOGICAL, OR PSYCHIATRIC ADVICE, DIAGNOSIS, OR TREATMENT. Never disregard professional advice or delay seeking treatment because of content provided by the App.

If you are experiencing mental health issues, sleep disorders, or any health concerns, please consult a qualified healthcare provider.

6. User Content

6.1 Ownership

You retain all ownership rights to the content you create, upload, or submit through the Service, including dream journal entries, voice recordings, and any other user-generated content ("User Content").

6.2 License Grant

By using the Service, you grant us a limited, non-exclusive, royalty-free license to use, store, process, and display your User Content solely for the purpose of:

• Providing and operating the Service
• Processing your content through AI analysis features
• Synchronizing your data across devices (if enabled)
• Improving and developing the Service (in anonymized, aggregated form only)

This license terminates when you delete your content or account, except where required for legal compliance or legitimate business purposes.

6.3 Content Responsibilities

You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to submit such content and that it does not violate any laws or third-party rights.

7. Subscriptions and Payments

7.1 Premium Subscription

Certain features of the Service require a paid subscription ("Premium Subscription"), including AI-powered dream analysis and cloud synchronization.

7.2 Payment Processing

All payments are processed through Apple's App Store. By subscribing, you also agree to Apple's Terms and Conditions for in-app purchases.

7.4 Cancellation

You can cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period. You will retain access to premium features until then.

7.5 Refunds

Refund requests are handled by Apple according to their refund policies. We do not directly process refunds. To request a refund, please contact Apple Support or visit reportaproblem.apple.com.

8. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Attempt to gain unauthorized access to any part of the Service or other systems
• Use automated means (bots, scrapers, etc.) to access the Service without our permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Circumvent any security measures or access controls
• Use the Service for any commercial purpose without our authorization
• Transmit viruses, malware, or other malicious code

Violation of this policy may result in immediate termination of your access to the Service.

9. Intellectual Property Rights

The Service, including all content, features, functionality, design, graphics, logos, icons, and software, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

"ONYRA" and our logo are trademarks of Manuel Thurner / 03-Studios. You may not use our trademarks without our prior written consent.

The Service integrates with third-party services including:

• Apple (Sign In with Apple, App Store)
• Google (Google Sign-In)
• Firebase (Analytics and performance monitoring)
• OpenAI (AI processing)
• Supabase (backend services)
• RevenueCat (subscription management)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party service providers.

You agree to indemnify, defend, and hold harmless Manuel Thurner / 03-Studios, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Grounds for termination include, but are not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of subscription fees
• Extended periods of inactivity
• Requests by law enforcement or government agencies

Upon termination, your right to use the Service will immediately cease. You may delete your account and data at any time through the App settings.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15.2 Dispute Resolution

Before initiating any legal action, you agree to first contact us at contact@03-studios.com and attempt to resolve the dispute informally for at least 30 days.

15.3 Jurisdiction

Any disputes that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Bolzano, Italy.

15.4 EU Consumer Rights

If you are a consumer in the European Union, you may also be entitled to use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. You also retain any mandatory consumer protection rights under the laws of your country of residence.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and us regarding the Service.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, labor disputes, or failures of third-party services.

This Section applies to your use of the App obtained from the Apple App Store:

• These Terms are between you and Manuel Thurner / 03-Studios only, not with Apple Inc.
• Apple has no obligation to furnish maintenance or support services for the App
• Apple is not responsible for any product warranties, whether express or implied
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them against you
• You represent that you are not located in a country subject to U.S. Government embargo
